MP HC seeks reply on vacant post of CIC

MP high court has sought reply from the state government within six days over steps taken to fill up the post of state chief information commissioner (CIC).

A division bench comprising acting chief justice KK Lahoti and justice S Kakade issued the directive after the appellant’s counsel informed the post is lying vacant for long.

The court was hearing an appeal filed by RTI activist Ajay Dubey.

The state government was not providing a copy of the Justice SK Pandey inquiry commission report to the appellant despite the State Information Commission recent order.

The inquiry commission submitted its report to the state government in 2007 relating to death of some 49 persons in October 2006 while crossing river Sindh in district Datia when all of sudden there was flooding due to release of water from nearby dam, Ajay Dubey, a Bhopalbased RTI activist said.

The district authorities did not inform the villages falling on banks of river Sindh about the water to be released from the dam in the night, he said.

The villagers were crossing the river to attend the fair organised at a temple in Ratangarh.

Action should be taken against Datia former district collector M Geeta and other authorities allegedly responsible for the incident, the appellant’s counsel Jitendra Jain said.

The appellant has to approach the high court since the post of chief information commissioner is vacant and for compliance of its order there was no remedy, Jain said.

The appellant has challenged the single judge bench order of July 24, 2013 rejecting the writ petition filed in this regard.
