For me the case is service to the nation: Dayan Krishnan

It was his moment of glory when the judge while convicting the accused in the gang rape case appreciated the prosecution for “displaying highest degree of professional standards and competence”.

For noted Supreme Court lawyer 45-year-old Dayan Krishnan, the special public prosecutor in the December 16 gang-rape and murder case, it’s a battle half-won.

Having secured the conviction of the four accused, he now aims the harshest punishment—death— for each of them as demanded by the parents of the victim and an outraged nation.

While accepting the brief on December 29, 2012,  Krishnan, an advocate with a vast experience in investigations and interrogation, made it clear to police that he will not be charging a fee.

“It was a ghastly and sickening crime. The task I have been entrusted is to secure maximum punishment for its perpetrators. I am seeing it as a service to the country. So I will not be charging any fee”, he told the police.

Krishnan who in the past appeared for Centre, National Investigation Agency, CBI and Delhi government and Delhi police in many high profile cases kept aside most of his private works for the past nine months and devoted himself to the gang rape case—studying voluminous evidence, preparing notes and drafting applications in the midst of examining a 84 witnesses of the prosecution and 17 of the defence. The task was more arduous being a day-to-day trial.

He was ably helped by Delhi police Inspector Rajender Singh and assistant prosecutors AT Ansari and Madhav Khurana. Several times Krishnan rushed to the High Court and Supreme Court where the lawyers for accused filed several petitions.

Questioning allegation that the trial had been delayed, prosecution sources said “this case can in no way be compared with Swiss gang-rape case of Madhya Pradesh in which verdict was delivered in four months. In that case there were only four witnesses while in this case there were 101.”

"The Delhi case was not being held at a court exclusively meant for the case but the judge was also bogged down by several other cases. Hearing in this case began only after 2 pm every day. Trial also got interrupted by accused Ram Singh’s suicide, accused Vinay’s illness, bereavement in the judge’s family and summer vacation of the court”, said the source.
