Cong leader remains in jail, Trinamool leader gets bail

Congress leader Sheikh Moktar, accused of ‘attempt to murder’ in the case of sub-inspector Tapas Choudhury’s killing, was denied bail on Friday at the Alipur court, even though co-accused Trinamool leader Mohammad Iqbal, who is also accused in the murder of Choudhury, has been granted bail in both cases Iqbal is accused in.
 
Iqbal was granted bail in the case registered under section 307 of the IPC (attempt to murder) last week, he got bail in the case registered under section 302 of the IPC (murder) on Thursday. The government lawyer did not oppose his bail plea in the court in either of his cases.
 
However, public prosecutors opposed the bail of Moktar in last week and on Friday, too. While Iqbal’s lawyer had leaded for bail on the grounds of his mother’s illness, Moktar’s lawyers had appealed for bail on the grounds of his father’s illness.
 
Police have filed charge-sheet in the case related to section 302 of IPC but they charge-sheet in the case relating to section 307 of IPC is yet to be submitted.
 
Special branch sub-inspector Tapas Choudhury was killed in front of Hari Mohah Ghosh college on February 12. While Moktar was arrested from Howrah station area on February 26, Iqbal, Trinamool councillor from ward 134 and the then chairman of borough no 15 of KMC, was arrested from Dehri-on-Sone in Bihar on March 7.
 
While a section of pro-government lawyers said that granting bail is jurisdiction of the judge and the judge is not bound to listen to the public prosecutor, other lawyers said the role of the public prosecutors were politically motivated.
 
“The administration is acting in politically motivated way and that is why Iqbal got bail but my cousin could not get bail,” Sheikh Javed, Moktar’s cousin, said.
