No voids in Rath trial, says military court

A military court has found no voids in the court martial proceedings against lieutenant general PK Rath, accused in the Sukna land scam. In January, Rath was found guilty of granting a no-objection certificate to facilitate the transfer of a 70-acre plot adjacent to the Sukna
military station to businessman Dilip Agarwal’s dubious educational society.

But the charges pertaining to intent to defraud were dropped.

Eastern Army commander Lt Gen Bikram Singh ordered reexamining of the court martial proceedings in June on the grounds that voids had been detected in the military trial.

But intent to defraud could not be proved again.

Rath's punishment remains the same — loss of seniority for 15 years for calculating pension, loss of service seniority for 18 months and severe reprimand.
