Court allows arms haul accused to attend sister's wedding

The special MCOCA court in Mumbai on Monday allowed Mohammed Muzaffar Mohammed Tanver, an accused in the Aurangabad arms haul case, to attend the wedding of his sister for four days in Aurangabad.

Judge S M Modak said he will have to bear the expenses of six police constables who will escort him to Aurangabad from the Mumbai prison where he presently is.

The court, allowing him to be out of jail from April 25 to April 28, warned him not to misuse the permission or indulge in any kind of objectionable activities.

He can be at the wedding during the day, but would be kept at Aurangabad central jail after sunset.

Earlier, his lawyer Farhana Shah said that his plea was based more on humanitarian grounds rather than on any legal rights.

The court also asked him to deposit the escort charges for 12 hours for six policemen, which would work out to roughly Rs. 54,000. Jail authorities had demanded escort charges for 24 hours which was about Rs. 1,84,000.

Jamiat-Ulama-e-Maharashtra, an NGO, is providing free legal aid to the accused in Aurangabad arms haul case.

In May, 2006, the state ATS arrested over a dozen people and claimed to have seized 16 AK-47s, 3,200 live cartridges, 43kg RDX and 50 hand grenades, among other arms near Aurangabad.

Muzaffar surrendered on May 10, 2006. He was allegedly driving a TATA Indica car which contained five boxes of arms and explosives.
