HC to state: File reply to Ashok Chavan’s petition

The Bombay high court on Monday directed the state government to file an affidavit in reply to a petition filed by former chief minister Ashok Chavan seeking to quash the FIR registered in connection with the Adarsh Co-operative housing society scam. The government has two weeks to file the affidavit.

On January 29, 2011, the CBI had registered an FIR and booked 13 persons for their supposed role in the housing society scam under various provisions of the Indian Penal Code as well as the Prevention of Corruption Act, 1988.

The Enforcement Directorate had registered a separate case against some of the accused for alleged money laundering.

Chavan has challenged the registration of the FIR and the CBI’s investigation on the ground that the agency has no jurisdiction to do so and its actions infringed the authority of the Maharashtra Anti Corruption Bureau.

Chavan said the state agency had initiated a preliminary inquiry in the Adarsh Housing Society scam before the CBI had registered its FIR.
