ND Deshpande imposed the cost while dismissing a petition filed by Khandelwal Laboratories, producer of pharmaceuticals and active pharmaceutical ingredients, challenging a notice issued by the Union government for overcharging consumers.

In April 2009, the Union government had issued notice to Khandelwal Laboratories and Healers Laboratories for allegedly overcharging consumers for tablet Norflox.

Khandelwal Laboratories and Healers Laboratories had entered into an agreement whereby the former would market the drug manufactured by the latter.

According to Advait Sethna, counsel for the Centre, the notified price or the ceiling price for a strip of tablets was Rs. 18. However, the maximum retail price printed on the tablets was Rs. 36.
