The Mumbai Suburban District Consumer Forum has directed Air India to pay Rs. 50,000 as compensation to Mumbai resident Darrel Pereira, who has claimed that the airline misplaced his and his family’s luggage during a trip to Tiruchirapalli in 2011.
According to Darrel Pereira, he had booked four seats on Air India’s flight to Tiruchirapalli for himself, his wife, and his two children.
On October 25, 2011, they boarded the flight after depositing their luggage at the check-in counter.
However, when they landed at Tiruchirapalli, they found that their luggage was missing. The bags were returned only after the family completed the round trip and returned home to Mumbai.
Pereira then issued a legal notice to the airline seeking compensation for the inconvenience and mental agony caused and ultimately, in April 2012, approached the consumer forum after the airline rejected his claim.
The bench of forum president JL Deshpande and member SR Sanap concluded that the family of four must have suffered a lot of inconvenience and mental agony as their luggage never reached the destination and they were forced to purchase clothes and other daily necessities.
The airline did not respond to the notice issued by the consumer forum, which passed the order in its absence.
The forum took into consideration provisions of the Hague Resolution for compensating air passengers in case their bags, kept in check-in luggage, go missing or financial loss is caused to the flyer because of misplacement.
It has directed Air India to pay the compensation amount to the Pereiras within a period of 10 weeks, failing which the national carrier will have to shell out an interest on the amount, at 9 % per annum from the due date, as per the order by the forum.
