People like Raj don't deserve importance, says HC bench

"Such people do not deserve any importance," the Bombay high court said on Monday, referring to Maharshtra Navnirman Sena chief Raj Thackeray's remarks about the court order rejecting his party's plea seeking permission for a rally at Shivaji Park during the last civic elections.

"People like you are giving them importance by filing these proceedings," the division bench of chief justice Mohit Shah and justice Niteen Jamdar told advocate Ejaj Naqvi, who has filed a contempt petition against Raj Thackeray for allegedly lowering the dignity of the higher judiciary.

"They don't deserve any importance," the judges added.

Acting on Naqvi's petition, on July 4, 2012, the court had issued notices to Thackeray and Maharashtra government. Naqvi alleged that Thackeray allegedly referred to the high court's decision not to grant permission to MNS for holding an election rally at Shivaji Park as "partisan".

Through his petition, the lawyer sought that Thackeray be held guilty of contempt of court for passing disparaging remarks and trying to "scandalise the court."

In May 2010, acting on a public interest litigation (PIL), the court had declared that the ground lies within the silence zone and restrained the BMC from allowing any non-sporting activities on the ground without the court's permission.

"The remark cast an unwarranted aspersion of partiality against the Bombay high court," Naqvi's petition said.

Before approaching the court, Naqvi had obtained permission from advocate general DJ Khambata for initiating contempt of court proceedings against Thackeray, as required under the Contempt of Courts Act.

On February 5, the high court had rejected a plea filed by the MNS seeking permission to hold an election rally at Shivaji Park stating that the venue fell in the silence zone and if one political party is allowed to hold a rally there, everybody else will start rushing to court.
