The Bhoiwada metropolitan magistrate court has sought a report from the police on what action has been taken in response to a legal notice sent by lawyer Abha Singh for not registering an FIR against MLA Kshitij Thakur. Thakur had allegedly abused and threatened traffic sub-inspector Sachin Suryavanshi, when he fined him for speeding on the Bandra-Worli sea link on March 18.

Magistrate Amit Kotlikar, on Wednesday, asked the Worli police to submit the report by May 2.

Activist Santosh Daundkar had lodged a complaint against Thakur on April 4. The argument between Thakur and Suryavanshi has been videotaped and the abuses could be clearly heard, he had alleged. Daundkar had also submitted copies of the official statement given by Suryavanshi to the inspector in-charge at Worli traffic police division. Copies of the station diary entry and detailed report submitted by the inspector in-charge to the assistant commissioner of police (ACP), traffic, Worli division were also submitted by Daundkar for filing an FIR against Thakur.

“Despite such strong evidence, the Worli police station refused to file an FIR against Thakur,” Abha Singh, advocate for Daundkar alleged.
Abha said that an FIR should have been filed against Thakur under sections 294 (for hurling filthy abuses) and 506 (criminal intimidation), along with Section 110 of the Bombay Police Act (for indecent behaviour) of the IPC.

Following the Worli police’s reservations in registering an FIR, Singh sent notices to the senior inspector of the Worli police station, additional police commissioner of the region and the city police commissioner. With no response even after a week, Singh moved court
Sadanand Date, joint commissioner of police, law and order, said, “I need to study the issue first before making any comment.”
