Tainted cops to be tried for forging presidential pardon

Two city police personnel, convicted in connection with a custodial death, face another imminent prosecution for forging letterheads of the President of India on the basis of which they had sought pardon from the Bombay high court.

The division bench of justice SC Dharmadhikari and justice SB Shukre on Wednesday said that it might accept the unconditional apology tendered by Dilip Parmar and Kantilal Mandole and may drop the criminal contempt proceedings against them in view of the fact that they have paid Rs. 50,000 each.

The bench, however, made it clear that the duo will have to face prosecution for forging presidential pardon letters.

The bench, however, deferred the matter till next week after finding that the affidavit tendering unconditional apology was not signed by Mandole, a former head

constable, who is serving his prison term in Kalamba Central Prison, Kolhapur. Parmar, a former sub-inspector, is absconding.

Another bench of the court had initiated contempt proceedings against the duo in November 2012, when it became clear that the presidential pardon letters produced by them in high court were never issued by the Presidential secretariat.

Parmar, Mandole and five other personnel attached to the DN Nagar police station had been charged with the custodial death of a 26-year-old in 1990. In April 1996, a sessions court had sentenced Parmar and Mandole to three years in prison. The high court and subsequently the Supreme Court had upheld their conviction.
