Advocating toughest punishment for those committing crime against women, a Delhi court on Tuesday sentenced to death two brothers who killed a 23-year-old man for objecting to them passing lurid remarks against his sister.

“Crime against women has to be tackled with all earnestness. This battle of half of the Indian population (women) is something that we cannot lose sight of and courts cannot let things pass in the name of mercy,” additional sessions judge Kamini Lau said, handing down death sentence to Sunil and Sudhir.

“Let the two convicts be hanged by the neck till they are dead.”

The order came four years after Subhash was beaten and stabbed to death in Sultanpuri in northwest Delhi.

The brothers’ four accomplices were given life imprisonment and fined Rs. 1 lakh each to be paid as compensation to the victim’s family.

All the six were convicted solely on the testimony of the Subhash’s sister. All other eyewitnesses, including the parents, turned hostile, giving in to threats from the accused.

The court withheld the girl’s name as identity of a sexual assault victim cannot be revealed.

“The girl had singularly stood up alone in this battle to secure justice for her deceased brother.  It was a lone battle for her…  The spirit of this young girl, who bravely stood up against all her odds, is required to be saluted,” the court said.

Late in the evening on July 20, 2009, the 19-year-old girl and her mother were watching a procession of kanwariyas pass through their locality in Sultanpuri.

Sunil and Sudhir, who lived in the area and had several cases pending against them, made some obscene gestures and taunted the girl. Her brother and mother objected.

Enraged, the two men and their four friends pounced on Subhash. As his sister watched helplessly, they attacked him with baseball bats and iron rods and then stabbed him repeatedly with broken liquor bottles, killing him.
