Accusing Unitech managing director Sanjay Chandra of attempting to ‘sabotage’ the 2G scam trial, the CBI has moved the Supreme Court seeking cancellation of his bail.

The move comes months after a sting operation exposed the alleged collusion between Chandra and CBI prosecutor AK Singh.  In an application in the top court, CBI has prayed for recalling November 23, 2011 order, releasing Chandra on bail accusing him of violating the bail conditions.

The agency alleged Chandra had “obtained advice on defence strategy” from Singh with regard to “three key prosecution witnesses.” Their evidence in the case has a direct bearing on Chandra’s defence, it said.

“It is clear from the conduct of the accused that there has been a clear and direct attempt to sabotage the conduct of this trial and to impact its outcome,” stated CBI’s application. Allowing Chandra to remain out of jail would be “detrimental to the conduct of the trial,” CBI has told the SC.

The CBI said Chandra also “materially interfered with the prosecution of the case…”  It would be no longer conducive to a fair trial to allow the accused to retain his freedom during the trial, the agency added.
