Delhi HC gives thumbs up to DU semester system

In a significant order, the Delhi high court on Thursday dismissed a petition filed by the Delhi University Teacher’s Association challenging the semester system introduced by the Delhi University in 2010 for undergraduate courses.

The court, after a two year hearing rejected the contention of the teachers that they and students were not properly informed about the system before implementation just because it was not published in the gazette.

DUTA had sought for a direction to roll back the semester system in the Arts and social social science streams and to follow the annual system which was being followed earlier.

They had gone on strike several times demanding the withdrawal of the system.

 “Non- publication in gazette would not make the amendments invalid in law”, a bench headed by acting chief justice BD Ahmed ruled.

The court however directed that the amendments to the ordinances be published in the official Gazette within two months.

“There cannot be any manner of doubt that all the colleges and institutions were aware and well-informed of the change to the semester system. The students were equally informed about this through prospectus”, the court said.

“We have consciously not been drawn into the debate as to whether the semester system is more appropriate than the annual system or vice-versa. The reason for this is clear. The courts are ill-equipped to comment on such matters or arrive at value judgments. These are matters for experts in the field of education. We have examined the matters from the stand point of law and have reached the conclusion that the writ petitions are liable to be dismissed", said the bench.

As of now, there are 13 courses, including physics, chemistry, botany and zoology, which follow the semester system in the university.
