The Enforcement Directorate (ED) has issued show cause notices to four companies for violation of provisions under the Foreign Exchange Management Act (FEMA) to the tune of R 3,806 crore in connection with the 2G spectrum scam.

Three companies, Loop Telecom, Loop Mobile (India) and DB Realty, have been show-caused for failure to report to RBI receipt of FDI and issue of shares to foreign investors, while Chennai-based ETA Star Property Developers has been issued a notice for failure to issue shares against FDI within 180 days and failure to report to RBI issue of shares to foreign investors.

The four companies have been given a notice for Rs. 399.50 crore (Loop Telecom), Rs. 26 crore (Loop Mobile), Rs. 2831 crore (DB Realty) and Rs. 399.50 crore (ETA Star Property Developers).

The 2G spectrum scam, unearthed by the Comptroller and Auditor General (CAG)’s office, involved undercharging mobile telephony companies licenses allowing allocation of frequency, to be used for creating 2G subscriptions for cell phones.

The Supreme Court in February last year declared the spectrum allotment as “unconstitutional and arbitrary” and quashed all the 122 licenses issued in 2008 during tenure of A Raja, the then communications and IT minister who is also the main accused in the 2G scam case.
