Man gets divorce from wife for false complaints

Delhi high court on Thursday granted divorce to a man who sought dissolution of his marriage on the ground that his wife had filed several "false" complaints against him and his family members. He said that her her actions amounted to mental cruelty on her husband.


Dismissing the plea of a woman challenging the trial court's order in favour of her husband, a division bench of justices Pradeep Nandrajog and V Kameswar Rao concurred with the findings of the family court.

"We have no hesitation in holding that by filing numerous false complaints against Sandeep (name changed) and his family members with the police and in his office — that Sandeep and his family members used to demand dowry from her and treated her with cruelty when she failed to fulfil their demands and that her husband was having an illicit affair with his colleague — she has caused mental cruelty to her husband, thereby entitling him to a decree of divorce under the Hindu Marriage Act," the bench said.

"A matrimonial dispute is not just a legal dispute but, more importantly, it is a family problem and a social concern.

Matrimonial disputes should not be viewed from the glasses of legal technicalities. They should be appreciated at the human level of being a conflict between a husband and a wife. Such issues should be dealt with sensitively rather than mechanically," the court also said in its judgement.

On December 14, last year, the family court had allowed the man's petition seeking dissolution of the marriage and dismissed the counter plea of the wife.
