Retirement age for lawyers proposed

The Bar Council of Delhi has proposed to fix the retirement age for lawyers to maintain high standards and efficiency in the profession.

This was stated in an affidavit filed by State Bar Council in response to a petition challenging Council's decision to disqualify persons who have crossed 45 years of age from enrolling themselves as advocate.

The Council, a statutory body constituted under the Advocates Act, 1961 meant to regulate the legal profession, also suggested 'periodical renewal of enrollment' as a measure to weed out corruption and inefficiency from the Bar.

"On the point of fixing the retirement age, it is being deliberated upon on the basis of some suggestions received in this regard from various lawyers and it is to be decided that what should be the retirment age."

However, when a bench comprising Justices Vikramjeet Sen and JP Singh asked the Council's lawyers in a lighter vein what would be the retirement age for the lawyers? Will it be 80 or 90? Council's advocate Sunil Mittal submitted 70 years as the retirement age for the lawyers from the active practice in the courts.

The age has a direct co-relation with the efficiency and aptitude level of the person concerned in the matter of any important position and its relevance cannot be ruled out as it (age) is being applied in all public appointments made through UPSC or State Public Service Commissions, the affidavit said.
