Sale of properties in newly legalised colonies hits hurdle

The sale and purchase of properties in unauthorised colonies, regularised in August, has hit a roadblock. Delhi government officials said the revenue department had sent a file in this regard to the law department, seeking its opinion and approval, but the latter is yet to take a call.


“We need the law department’s go-ahead on the sale and purchase of properties in such colonies,” said a senior Delhi government official.

In September, chief minister Sheila Dikshit had announced that sale and purchase of properties would be allowed in 320 of the 895 colonies regularised by the government.

These 320 colonies are on private land, while the rest on government land. Another problem is that khasra numbers of some of the properties in unauthorised colonies are missing, hindering the layout-making process.

“We have asked the department to look into the problem and find out the number of these properties,” added the official.

“The law department has been asked to look into the issue from all angles. The issue being debated is that it is the colony that has been regularised and not properties. Hence, giving a green signal to the sale and purchase might create problems later as many properties have been purchased on the General Power of Attorney and have not been registered,” he added.

According to officials, a decision on the sale and purchase would be taken soon. “The sale and purchase of properties will be allowed in the colonies only after a regularisation certificate is issued. Then, they will also become liable to pay property tax,” said the official.
