Talwars seek fresh probe in Aarushi case

Tuesday’s hearing on the Central Bureau of Investigation (CBI) closure report in the Aarushi-Hemraj murder case was adjourned, following the attack on Dr Rajesh Talwar inside Ghaziabad court complex. The next hearing will be on February 8.

During the hearing, Talwar’s lawyers submitted a nearly 50-page protest petition to the CBI special judicial magistrate and sought further investigations into the case and the rejection of the CBI's closure report.

In their application, Talwar said unsubstantiated inferences were drawn by the CBI in matter relating to the postmortem of his daughter Aarushi and domestic help Hemraj Banjade. It also said the CBI failed to investigate the possibility of an intruder, known to Hemraj but not to the family, who could have had access to the house.

"If after examination, it is established that no DNA of any present suspects was found, the DNA on the evidence left behind by the culprits, including the whisky bottle, bloody hand print found on terrace, Aarushi’s schoolbag and clothes, could have given a definite lead in the role of an outsider in the crime," Talwar’s lawyer Praveen Rai said. The petition also stated that the foot print found on the terrace after the murders was also not investigated.

The petition also sought touch-DNA tests of the evidence. But a CBI source said touch-DNA method was not feasible. “The cost does not matter to the agency. The Talwars  are referring to a specific lab  but it is not an authorised one," the source said.

CBI counsel RK Saini said the agency was ready to answer questions raised in the petition.
