Raising allegations of injury and neglect to 16-month old Indrasish Saha in foster care in the US, academicians, social activists and retired justices petitioned US ambassador to India Nancy J Powell on Thursday, for immediate repatriation of the child to India.

They have alleged the US body had robbed the baby’s “religious and cultural rights”.

On September 7, 2012, the US authorities took away the baby from his parents Debasish and Pamela Saha alleging negligence. The parents said he had fallen from the bed but the US authorities alleged that the baby was suffering from Shaken Baby Syndrome.

The matter is since being heard in a US court. The family will lose the right of getting back the child if he stays in foster care for more than 12 months.

“My grandson is being neglected and he is injured. Moreover, the child is traumatized after being kept away from his near and dear ones,” paternal grandfather Nirmal Saha told Hindustan Times over phone from Balurghat in South Dinajpur.

According to the petition, in November 2012, the child was “wounded in the lower lip” in what the foster care claimed was an accident. On December 31, he had to be “hospitalised in emergency care for extreme dehydration”.

The letter also alleged that though a cyst was detected in Indrasish’s brain, the foster care-givers merely limited his medical examinations to that covered by the insurance as per foster care norms.

The signatories include former Delhi high court chief justice AP Shah, CPI(M) leader Brinda Karat and former NCW chairperson Mohini Giri.
