North civic body seeks to legalise fourth floors

In a move that can spell relief to lakhs of north Delhi dwellers, the North Delhi Municipal Corporation on Monday passed a motion to regularise four-storey buildings that have a total floor area ratio (FAR) of 400.

At present, the building laws allow a FAR of just 350 for such buildings.

In the motion passed on Monday, the corporation decided that buildings spread over 175 square metres or more and built before 2007 ought to be regularised. Demolishing them would render many families homeless, it reasoned. According to the leaders, nearly 70-80 per cent of homes in Delhi have added floors and covered compounds and balconies by adding extra rooms.

“Homes in special areas, urban villages, unauthorised regularised colonies, unauthorised colonies and authorised plotted colonies where construction was done before 2007 must be regularised if they do not exceed a height of 15 metres. The motion passed on Monday also included a provision to regularise three-feet barsaatis built on homes that are not more than 10 feet.

Seen by some as a tactic to woo voters in the run up to assembly elections, the motion will have to be accepted by the Delhi Development Authority (DDA) before it can be implemented. “Only DDA can make changes to the Master Plan to ensure these buildings are regularised,” said a senior official of North Corporation.

If the regularisation does not happen, it becomes the corporation’s duty to demolish the fourth floors of such buildings as they become illegal construction. According to leaders, 80 per cent of residential buildings in the city have added floors without following building bylaws and it is impossible to take action against each one of them.
