Police have registered a first information report (FIR) in the building collapse case at Mahim, in which 10 people lost their lives.

Five persons including the owners of the building, Aftab Manzil, have been charged under various sections of the Indian Penal Code (IPC).

Unidentified civic officials of the local ward have also been booked for alleged connivance.

The FIR was registered on Saturday following a complaint filed by advocate Rizwan Merchant, who lost three members of his family in the collapse on June 10.

According to the FIR, the Furniturewala brothers Irfan, Sharif and Mohammad Ali, who own the building, did not go to the office of the sub-registrar of assurances for admitting execution of documents and hence the formation of society was never done.

The three are son of late Altaf Furniturewala, the landlord of the building. “As there was no society, the repairs and maintenance of the building could not take place,” Merchant explained.

The structure, which was already weak, was further damaged by but the illegal alterations made in the basement, alleged Merchant.

The FIR states that the fourth accused, Iqbal Ibrahim, owner of the shop and basement on the northern side of building, had leased the space to the fifth accused, Sandeep Bafna, to run a car showroom.

“Bafna carried out rampant modifications, which I brought to the notice of the ward officer, but no action was taken,” said Merchant.

The Mahim police said they had informed the immigration department to ensure that none of the accused would flee the country.

“We are investigating which BMC officer visited the site when the complainant [Merchant] notified them about the structural changes and why no action was taken in the matter,” said Avinash Sonawane, senior inspector, Mahim police station, adding that none of the accused were found at their respective homes.
