HC admits appeal against acquittal of 2

The High Court on Tuesday admitted an appeal filed by the state government against the acquittal of Usman Ladoowala and Hasan Batterywala who were accused in the twin blasts that took place in the city in August 2003.

The duo was arrested on November 5, 2003 for their alleged role in the twin blasts at Gateway of India and Zaveri Bazar on August 25, 2003.

The government had challenged the duo’s acquittal by the special Prevention Of Terrorism Act (POTA)  judge from

all charges on November 17, 2008. The two were acquitted after the POTA review panel said there was no evidence against them under the Act.

The government’s appeal contended that the POTA review committee went beyond its jurisdiction in interpreting material evidence against Ladoowala and Batterywala. 

The police had recovered 750 gm of RDX from Batterywala’s auto repair shop in Kurla and two detonators from Ladoowala’s Mumbra residence on November 11, 2003.

HC has kept the matter for final hearing in November.
