Class 9 girl 'gangraped' in Rajouri, 2 held

A Class 9 student and a resident of Panihad village under Darhal police station has leveled allegation of gangrape against three persons, including a Class 12 student, a police constable from local MLA's police escort and a CRPF jawan after she said she was kidnapped from her house at gun point on October 10.


The girl in her statement at district hospital alleged that she was first kidnapped by a policeman and a CRPF jawan from her house at gun point and later taken to nearby village, where they committed the crime at a woman's room, who reportedly works in an anganwari.

The accused have been identified as police constable Basharat Hussain; CRPF jawan Kabir Hussain; and Shamsheer Hussain, a Class 12 student. They are all residents of the same village to which the girl belongs.

The Darhal police brought the girl to district hospital in Rajouri on Saturday for medical check-up. DSP M Basu Station House Officer (SHO), Darhal police station, said that on the complaint of the girl, the police have started investigations and have arrested Samasheer Hussain, and CRPF jawan Kabir Hussain.

“As the third accused is on official duty with an escort of a VIP (local MLA), the police have approached the senior police officers for his custody,” the DSP said.

He further added that the police was waiting for the medical report of the girl, to register a case against the accused under relevant sections.

The father of the girl said that his wife was admitted to a private hospital in Jammu, while he was in Rajouri with his leg and arm fractured in an accident.

“My three children were in the house, when on October 10, all three accused entered my house and took my daughter along with them,” he said.

The victim said that they took her to the house of one Meeran Baksh, panch of Gurha Sarkari village, and kept her there for the whole night. She said that she was gangraped by the three in the room of an anganwari 'madam' (sister-in-law of the panch) for the whole night.

“I was threatened by the abductors to not to raise an alarm, as they said they would kill my father and my brother,” the girl said.

She further said that they were planning to take her to Jammu and then to Punjab to sell her.

“To execute their plan they took me to Mandargala via a dense forest and from Mandergala we boarded a bus bounded for Kotranka, as they wanted to take me to Jammu via Budhal in Reasi district,” she said.

The girl's father informed that immediately after the kidnapping, his son approached the police at Piri police post and an alert was sounded from Darhal police station.

“She was traced by the police at Kotranka after we provided the details of the clothes she was wearing. But the abductors accompanying her dodged the police,” he said.

After the information received by the Kotranka police, the girl was brought back and the family moved a formal application against the accused at Darhal police station.

Ch Zulfikar, MLA from Darhal, on being informed about the incident said: “The security department is responsible for deploying the police escort to the VIPs. He (Basharat) could be a member of my escort but is certainly not my PSO, as alleged by few persons.”

Meanwhile, girl's father alleged that the police were trying to hush the matter saying that they have sent an application asking him to sign the same saying that his daughter was mentally challenged.

“I refused to do so. If the FIR is not registered, I will be forced to approach senior police officers and even the court,” the father said.

The DSP, however, said that he had no knowledge about the development and whether anybody had approached the girl's father with the letter. He said that he (the father) should inform the police and strict action would be taken under law against that person.

"Police have registered a case under Sections 363,109 of the RPC (FIR 56/13) and if it is proved in the medical report, which is still awaited, the police will add Section 376 of the RPC (rape),” he added.
