question states that the girl had left her house on her own on a motorcycle with Nishan, the main suspect, while the police fact file shows it as kidnapping in broad daylight. The letter might have been written by the kidnapped girl under pressure.
"On September 23, my uncle told me that Nishan contacted him and he had told him to take me with him (Nishan) because my parents harass me too much. On September 24, my maternal uncle engaged my family members in talks and signalled me to leave and I opened the main gate and Nishan stood there and I left with him on motorcycle. No fight took place and no shots were fired," the letter reportedly written by Shruti states.
But on the other hand the police case registered against the accused shows that the girl was kidnapped from her home at 9.45 am by Nishan Singh and his accomplices and a case on September 24 has been registered under Section 307/452/363/366-A/148/149/323/120-B of the IPC besides Sections 25/27/54/49 at city police station, which find the alleged letter in contradiction to the police claims.
The police then claim to have recovered the car used in the crime from Moga, which contradicts the claims in the letter. The letter says that the girl had left on a motorcycle with the accused while actually she was kidnapped forcibly in a car. The police later on even recovered a Ford Ikon car from Moga.
The analysis of the letter in question belies all the police claims, which failed to match the big differences between the letter and the incident in their own record.
The letter has been written in Punjabi while signed in English.
The police also failed to think over the legal issues of the case registered against Nishan Singh on June 25 and the girl's statement to the police under Section 363/366A, 34 of IPC, to which they added Section 376 on August 10, 2012.
In the earlier statement to the police by the girl, whose letter the police believes to be true, she alleged the accused first raped her in her bedroom after her abduction and then raped her for days in an unknown house at Chandigarh.
"Nishan has destroyed my future and so strict legal action should be taken against him," the girl had stated before the police.
Even though the police knew the fact that in the eye of law she is a minor, the girl has recorded her date of birth to the police statement given in an earlier case as May 1, 1997 and was only 15 years and 2 month old when she allegedly got married after she left home in June and moreover she is a rape victim, the police made all her photographs public to the media via email. The legal experts say, consent of the girl and her alleged marriage carry no weight at her age.
But in hurried manner to cover up their failure in arresting the suspect and recover the girl, the police went ahead with releasing the letter and photographs of the girl showing her married without taking care of the girl's age and seeing that the letter on which they are basing their theory to project the case as elopement is fully contradicting the official record of the police.
SSP, Faridkot, Gurinder Singh Dhillon declined to comment on the letter saying the investigation is going on in the case and police are continuously conducing raids to nab the accused.
