The residents moved court soon after around two dozen odd guards and bouncers, allegedly hired by the builder, entered the premises to reclaim the security. Two women and a senior citizen were injured after being pushed by the goon, the residents said.
“We moved court as residents have the lawful right to take over the maintenance under the Haryana Apartment Ownership Act. Orchid Infrastructure Developers Private Limited (OIDPL), which developed the society is yet to hand over the charge to the residents’ welfare association despite missing several deadlines,” said Pooja Aganpal, the counsel for the RWA.
The builder, however, argued that the residents had illegally taken over the maintenance, operation and security of the premises.
The court of chief judicial magistrate Rajesh Sharma will hear the case on Wednesday.
