A real estate society has been found to have violated key provisions of the Punjab Apartment and Property Regulation Act, 1995 (PAPRA) under the Greater Mohali Area Development Authority (GMADA), putting at risk nearly Rs.
200 crore of its 400 members.
Sky Rock City Welfare Society at Behrampura villagers in the district collected Rs. 10 lakh to Rs. 85 lakh from each of its 400 members despite not having developer's licence, a mandatory requirement for carrying out such a step. As punishment GMADA has cancelled licence of the society's promoter, which means cancellation of its registration with GMADA.
Launched in August 4, 2010, Sky Rock City Welfare Society had decided to allot 234 plots ranging from 100 square yards to 500 square yards to its members in two years. It then issued advertisements in local newspapers, started developing the site and collected money from prospective house owners for Sectors 111 and 112 of SAS Nagar. But what it did not reveal to the gullible investors was that the society had no authority to resort to these steps. The members have now decided to fight back.
A delegation has submitted written complaints to the senior superintendent of police (SSP) in SAS Nagar, demanding registration of a criminal case against the seven-member governing body of the society. The aggrieved members have formed Sky Rock Hitt Bachao Committee.
Saucha Singh Kalaour, president of the committee, said, “The members have given lakhs of rupees for buying plots and governing body of the society has collected nearly Rs. 200 crore from members and because of the violations of the act, we are at the receiving end.”
“We invested money after we were told that it is approved by the Punjab Urban Development and Planning Authority (PUDA), but for more than a year members are being harassed. We will make sure that criminal complaint is lodged against the governing body of the society,” says Kalaour.
When contacted, Navjeet Singh, president of the Sky Rock City Welfare Society, said, “We cannot give them plots as we have not got clearance from GMADA. Moreover, we have got the stay from secretary, housing and urban development, after we appealed against the decision of GMADA. Also, we have paid nearly Rs. 4 crore to GMADA for getting change of land use for 25 acres besides completing other formalities. We have got 58 acres of land and the moment we will get clearance from GMADA, will give them plots.”
Speaking to HT, additional chief administrator, GMADA, Manjit Brar said, “When it came to notice of authorities that the society was releasing advertisements in print and electronic media in violation of the PAPRA, we took cognisance of it and after giving them the opportunity to present their case, promoter's licence of the society was cancelled.”
SAS Nagar SSP Gurpreet Singh Bhullar said, “We have received the complaint and I have marked an inquiry to SP (city) Swarandeep Singh, who will be giving the report.”
The society only had promoter's licence, which means it has registration with the Greater Mohali Area Development Authority
