After the trial court dismissed their plea, the accused moved Supreme Court which on Monday declined to entertain it. The couple have now moved the Allahabad High Court.
It is not for the first time that Talwars have exercised their legal options. Earlier, they had challenged the summoning order of the special judicial magistrate and filed transfer petitions in the SC after Rajesh was attacked in the Ghaziabad court.
It has taken nearly four years for the case to reach trial stage. But with the Talwars adamant on summoning 14 witnesses, the trial again appears to have stuck.
To approach superior courts, Talwars have sought many adjournments. Taking strong exception, the trial court on May 14 said: “Court cannot be a silent spectator by leaving the control of the trial to the accused, who have, as appears, decided not to take the case forward.”
