The UT estate office has decided to auction commercial and residential sites resumed by them for various violations on which there are no stay orders from court.
According to official figures, there are over 500 sites resumed by the estate office in different parts of the city, of
which around 100 buildings do not have stay orders on them, while the remaining cannot be get vacated since the appeals of the traders are still pending with court and other authorities.
According to court directions, the estate office cannot get a resumed property vacated till the appeal is decided. In many such cases, eviction is pending for more than three decades.
Giving details, assistant estate officer (AEO) Rahul Gupta said, "We have initiated the process by compiling the list of properties, which have been resumed and have no stay on them. Once the complete data is compiled, the authorities will initiate eviction proceedings and later the sites will go under the hammer."
"The date of auction will be decided after the completion of entire process," Gupta added.
The estate office has not held any auction since December 2009. In 2010, the administration had planned auction of residential and commercial sites, but it was cancelled at the last moment. As a result of delay in auction, the administration is losing out on huge revenue which can be earned through auction.
Recently, the UT administration had conducted a study of rates prevailing in surrounding areas for fixing reserve prices of properties it plan to put under the hammer.
Meanwhile, the estate office had been drawing flak for failing to handle the cases of building violations. To put a check on the menace, estate office recently started serving notices under Section 10 of the Chandigarh Estate Rules, 2009. But they were later forced to stop serving notices to "unauthorised" occupants of such premises on the direction of the administration.
This was for the first time that the estate office had started serving notices and defaulters were directed to remove the building violations within two months from the date of notice. According to the notices, the penalty on account of building violation and misuse shall be borne by the occupants every month.
