If you ever had your expensive clothes ruined by an indifferent tailor or the dry cleaner, this may come as good news.
The Mumbai Suburban District Consumer Forum has penalised a cloth shop whose in-house tailor spoilt the suit cloth purchased by a Navi Mumbai resident in September 2008
for his son’s wedding.
The forum has directed the owner of Anand Premium Collection at Chembur to refund the cost of the cloth, Rs9,152, along with interest at the rate of 10% per annum from April 2010 when Vishnu Pawar had approached the consumer forum.
The shop owner has also been directed to pay the Kamothe resident an Rs4,000 towards compensation and cost of litigation.
In September 2008, Pawar had purchased cloth from the shop for a three-piece suit for the marriage of his son which was scheduled on October 19 that year.
He was told the shop also provides tailoring services and the suit would be ready in time.
He, however, found that the shirt, trouser and the suit were not stitched properly and the subsequent alterations attempted by the tailor were also faulty.
Eventually, however, Pawar approached the consumer forum in April 2010 to recover the money he had spent on the suit cloth that handed over for tailoring.
Acting on the complaint, the consumer forum issued a notice to the shop owner, but then decided to proceed ex parte after the shop owner failed to respond to the notice.
From the evidence that has been tendered by the complainant, the forum noted that the complainant had lost Rs9,152 on the cloth and also must have suffered mental agony, as he could not use the new suit during his son’s wedding.
It held that the complainant was entitled to refund. Accordingly, Pawar will get now collectively get Rs17,728. The forum has given the shop owner a month to comply with its directions
