The police have applied three more sections against the five men accused of gang-raping a 22-year-old photojournalist.
During their investigation, the police found that the accused had hatched a conspiracy, forced the survivor into having unnatural sex with them and also made her
clean the crime scene after the rape.
In the remand application of Siraj Rehman Khan, 24, Vijay Jadhav, 20, and Kasim Bangali, 20, who were produced before a magistrate at the esplanade court on Friday, the police added sections 377 (unnatural sex), 120B (criminal conspiracy), and 201 (destruction of evidence) of the IPC.
The crime branch said the three sections were added on the basis of a detailed supplementary statement of the survivor, which was recorded on Thursday.
Meanwhile, Bangali’s mother moved an application stating that her son was a minor and a medical examination would prove the same.
However, prosecution lawyer Kiran Bendbhar contended that there were several cases registered against the accused in the past, but the family never disputed his age.
The court rejected the petition after Bangali’s lawyer Moin Khan said he did not have any document to prove that Bangali was a minor.
The prosecution sought for further police remand of the accused as they wanted to interrogate the three along with Mohamed Salim Ansari, 27, who was arrested from Delhi and is in police custody till September 5.
Bendbhar also said that the police had to investigate other cases of rape allegedly committed by the accused.
While extending the police custody, the court observed that substantial progress had been made in the case, but the investigation was still incomplete.
The three accused were remanded in police custody till September 5.
