The District Consumer Disputes Redresssal Forum, Chandigarh, has dismissed a complaint filed by IAS officer Ashok Khemka against the Central Government Employees Welfare Housing Organisation.
Khemka had moved the consumer forum saying the organisation had floated the Mohali Phase-1 housing
scheme in 2006 and he was declared successful in the draw of lots for a Type-D dwelling unit.
It was contended that the housing organisation raised a demand dated August 31, 2007 for Rs. 4.14 lakh towards the second instalment, which was sent to the complainant at the Chandigarh address to be paid by October 12, 2007, failing which 15% interest was to be charged.
The complainant to avoid the interest liability paid the amount but later while surfing the website of the housing organisation on July 29, 2008, Khemka came to know that the last date for payment of the second instalment was July 30, 2008 and not October 12, 2007 as intimated to him.
Khemka sent a letter to the housing organisation seeking compensation for payment of the second instalment by October 12, 2007, due to wrong intimation of the due date and demanded an interest of Rs. 49,850 calculated at 15% for 293 days. However, he was informed that the interest would be worked out and adjusted at the time of calling of the final instalment.
He alleged that in September 2013 he was sent an intimation for payment of the final instalment by November 29, 2013 and an interest of Rs. 1,098 for late payment of the fourth instalment by three days was calculated and charged at 15% per annum from the complainant.
The complainant moved the consumer forum with the prayer for a direction to the housing organisation to revise the final demand by allowing the benefit of interest at 15% for the period of 292 days instead of the benefit at 7%.
However, the consumer forum on November 13 dismissed the complaint on territorial jurisdiction.
