In a major setback to over 75 cooperative group housing societies in Chandigarh, the administration has imposed an embargo on transfer of leasehold flats. Now, only freehold flats' ownership can be transferred.
This overrules the current provision as per which both freehold and
leasehold flats - provided there were no building violations - could be further transferred. Now, leasehold flats can be transferred only after they are converted to freehold - for that, the buyer will have to get a conveyance deed registered after paying collector rates and get a no-objection certificate (NOC) from the estate office.
The collector rate is the minimum rate at which the property is registered, and nobody would be allowed to purchase land and immovable properties in different categories below the rate determined by the administration. The collector rates are annually increased. Last year, the administration had hiked the collector rates by up to 50%.
Confirming the development, joint registrar corporative societies Balbir Singh Dhol said that only freehold flats would be transferred.
In city there are a total of 112 group housing societies having over 15000 flats. Out of total, only 35 societies are on land allotted on freehold basics.
Last year, the administration had banned transfer of leasehold industrial plots.
Decision uncalled for
Criticising the administration, Group Housing Cooperative Societies Welfare Council chairman Satish Chandra Sharma said that the decision is totally uncalled for and will make things difficult for the societies.
It is pertinent to maintain here that the administration is yet to decide the rate of converting leasehold flats to freehold.
Satish Chandra Sharma stated that they will take up the matter with administration for rolling back the decision. "We will move to home ministry if we fail to get desirable response from the administration," said Satish Chandra Sharma.
Group Housing Cooperative Societies Welfare Council has been at the loggerheads with the administration over alleged discrimination being faced by the residents of the group housing societies. Satish Chandra Sharma said that internal development in the societies was approved by the finance department and approval was communicated to the Chairman Chandigarh Housing Board on May 17, 1994 for implementation, but no action has been taken till date.
