“We have received the Maharashtra government’s sanctions to prosecute suspended IAS officials Pradeep Vyas and Jayraj Phatak in the Adarsh housing scam. Our request for the sanction was pending for around 20 months,” said a CBI source.
The source said, “We will inform the trial court about the development so that the proceedings may begin.”
Vyas was accused of accepting false documents as proof of income, while Phatak was accused of illegally regularising the additional floors of the society.
Referring to the HT report ‘CBI sends reminder to Maharashtra government’, former Central Information Commissioner Shailesh Gandhi had also sought from the state disciplinary action against officials for the alleged delay.
According to Gandhi, Rule 10 of the Maharashtra Government Servants Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act, 2006, lays down that if a file remains without a decision in a department for more than three months, disciplinary action is to be taken against the officers responsible.
HC questions sanctionThe Bombay HC on Wednesday sought to know from CBI if sanction was required to prosecute former Maharashtra CM Ashok Chavan on corruption charges in the Adarsh Housing scam case. Justice Sadhana Jadhav raised the query while hearing a revision petition filed by CBI seeking permission to delete Chavan’s name from the FIR in the case following refusal of grant of sanction to prosecute from Maharashtra Governor Kateekal Sankaranaryanan.
