Project managers SK Mahajan, Harish Suri, BB Wadhwa, Rana Banerjee and one Shikha Mahajan have also been named in the FIR.
Buyers of the Rs. 400-crore Unitech’s Uniworld Gardens-2 in Sector 47 had complained of inordinate delays in handing over the apartments on the pretext that the approach road to the project was under encroachment.
Buyers have alleged in the FIR that the developer had deliberately concealed the fact that the road had been under encroachment in the original plan prepared in 2000. “It was the duty of Unitech to apprise the buyers regarding the correct position of the project,” the FIR stated.
The FIR said government agencies were also complicit as “the zonal and building plans were approved by different government agencies despite the fact that the main road was under illegal occupation.”
The developer has maintained that there has been no encroachment on any land and has passed on the buck to the HUDA. It argued that slum clusters had come up on the land owned by HUDA. Unitech also said it was making arrangements for an alternative road.
“As per media reports, there appears to be a baseless and frivolous complaint filed against the company. We have not done any wrong and this issue has already been examined in the past by the respective government authorities and they did not find any criminality in this matter,” said a Unitech spokesperson.
