The bench permitted the CBI to proceed against the accused police officers and other accused in accordance with law.
Rizwanur’s family reacted to the verdict saying it was a setback. “We still believe that my brother was murdered,” said Rizwanur’s brother Rukbanur Rehman. “However we welcome the verdict of the judiciary… We want the proceedings to eventually lead to appropriate punishment for the guilty.”
The SC verdict, which comes on appeals filed by CBI and Todi, said the high court’s May 2010 order which directed the CBI to pursue with the matter as a murder case was unacceptable.
Rizwanur was found dead near railway tracks in Dumdum area of Kolkata on September 21, 2007, a month after his marriage to Todi’s daughter Priyanka. The CBI charged some senior IPS officers as accused in the case, apart from Todi and his relatives. After a probe, the agency had concluded that the accused could be charged with abetment to suicide as Rizwanur had killed himself.
