Senior inspector Pradip Suryavanshi on Thursday refuted allegations that he threatened a metropolitan magistrate.
Ramprasad Gupta, brother of alleged Chhota Shakeel aide Ramnarayan who was gunned down in an encounter in 2006, and the magistrate who conducted the inquiry, had accused Suryavanshi.
Suryavanshi filed affidavit in reply to a notice issued by the court as to why he should not face action.
The notice was issued following a petition by Ramprasad seeking police protection.
The court has kept the matter for hearing after one week and asked Suryavanshi whether he wants to tender an unconditional apology.
Suryavanshi’s counsel Prasad Dhakepalkar said tendering apology would mean accepting that he threatened the magistrate, which never happened.
Ramprasad’s counsel Shyam Marwadi argued that the police didn’t provide any security to Ramprasad although he was threatened. Marwadi also pointed out a letter by Mrs Shaikh, railway magistrate, Andheri Court, which said that
Suryavanshi threatened her.
Dhakepalkar said, “He has been with the police force for 31 years. He is not a fool to threaten a magistrate.”Suryavanshi’s affidavit stated, “I have never, directly or indirectly in any manner, intimidated the honourable
magistrate at any time nor ever sought to bring any indignity to the office or person.”
Suryavanshi has also stoutly denied Ramprasad’s allegations that he (Suryavanshi) and other police officers had “participated in the said operation and were responsible for the extrajudicial execution of the petitioner’s brother”.
Suryavanshi said he is aware of adverse orders and remarks by courts, which provide for appeals for checks.
“Because the magistrate gave some findings which were contrary to our claim of having had to open fire in defence of self, surrounding and public, I would not react emotionally and/or be so immature and/or foolhardy to indulge in any of the acts attributed to me (of threatening the magistrate),” added the affidavit.
Ramnarayan alias Lakkhan Bhhaiya, an alleged Chhota Rajan gang member, was killed in an encounter in 2006 at Versova near Nana Nani park by a team lead by Suryavanshi.
