“This court does not find any merit in the petitions”, said Justice S Muralidhar imposing a cost of Rs. 25,000 each on the petitioners.
The Ansals argued the magistrate was wrong in summoning them “on the basis of a supplementary chargesheet without any fresh material on record”. The lower court had in January 31, 2003, ordered a probe after some documents related to case went missing from court record room.
After the probe, DC Sharma, a court employee, was dismissed by the district judge for tampering with the court records on June 25, 2004.
