The division bench of Justices Bilal Nazki and A.R. Joshi on Friday directed additional public prosecutor Poornima Kantharia to file a reply in two weeks.
Kaskar’s lawyer Jagdish Shetty said that the MEA should be directed to remove the observation from their passport so that the family can travel to other countries.
The family is settled in Dubai.
In April, the MEA has asked the Kaskars to approach the high court if it wanted to remove the observation.
According to the petition, his wife is educated with a Diploma in Audio Engineering and has no criminal record. It says that all children are students and they don’t have any criminal records.
Shetty argued that Kaskar was deported from Dubai in 2003 after he was shown as wanted in two crimes. He was discharged in one case and acquitted in the second.
