The Rajasthan high court on Wednesday reserved its order on a plea seeking criminal proceedings against Gujarat chief minister for allegedly making defamatory statements against late prime minister Jawaharlal Nehru. A single bench reserved its verdict on a petition filed by Charmesh Sharma, a member of Youth Congress wing of Bundi, who had objected to Modi's speech aired by the media.

Justice Mahesh Chandra Sharma will pronounce a detailed order as to whether the criminal court at Bundi can prosecute Modi under Sections 499 and 500 IPC for defaming Nehru.

The Chief Judicial magistrate and Additional Sessions Judge Bundi had earlier dismissed the plea. The trial courts were of the view that the court had no jurisdiction in the matter.

Modi's counsel contended that no action against him can be taken as the complainant is not competent under section 199 Cr.P.C.to file the complaint for defamation for Nehru as the law provides that only the 'person aggrieved' can file a complaint.
