Industrialists of IMT (Industrial Model Town) Manesar, protesting against Haryana government's move to levy additional charges for land given to them about two decades back, have decided to move the Punjab and Haryana High Court.

(HSIIDC) has sent notices to the industrialists, asking them to pay additional compensation to the farmers for their acquired land. The notices were sent after the Supreme Court in 2010 ordered HSIIDC to pay enhanced compensation to the farmers from R4 lakh per acre to R10 lakh per acre.
Now, two groups of industrialists — IMT Association and the Manesar Industries Welfare Association (MIWA) — will file separate petitions challenging the HSIIDC's decision before the high court.
Despite having similar causes, both the associations have refused to join hands. “Our representatives are in Chandigarh working out the final petition. We shall file it within a day or two," said Manoj Tyagi, general secretary, IMT Association.
Manmohan Gaind, general secretary, MIWA, said, his organisation will file a separate petition in the high court next week. "We are doing it with a sincere cause and we will go alone,” said Gaind.
Though legal experts say that the high court may ultimately club the two petitions, both the industrialists’ see no possibility of coming together.
"We have tried to join hands, but in vain," said a representative of IMT association.
The industrialists’ allegation
The IMT Association and MIWA alleged that HSIIDC has amassed over R600 crore by auctioning around 60 per cent of the land for commercial and industrial plots, violating the limit of 55 per cent, as per norm.
According to the Haryana Development and Regulation of Urban Areas Act, 1975, only 55 per cent of the project land can be used for commercial purposes and the rest for developing utilities like roads, drainage, parks, green belts, among others. This can be extended up to another 10 per cent with an approval from the Town and Country Planning Department (TCP).
IMT, Manesar which is spread over 3,500 acres of land, houses nearly 2,000 industrial plots. The issue pertains to plots earmarked for development of Phase-1 of IMT which is spread in nearly 1,746 acres having residential plots in Sector-1, commercial plots in Sector-2
and industrial plots in sectors 3 to 7.
