HC allows 7/11 accused’s defence to examine cops
The trial court can now summon the officials for examination by the defence lawyers.
The high court is however, is yet to pass its order on another application made by the accused seeking examination of investigating officers of the 7/11 blasts case and nodal officers of mobile service providers regarding availability of CDRs.
Petitioners claim that during their arrest in 2006, the ATS had relied on these CDRs recovered from their mobile phones while seeking their remand. Authorities, however, did not rely on the call records while filing of the charge sheet.
The ATS had earlier told the court that none of the CDRs relating to the July 11, 2006, serial blasts were relied by the prosecution or were part of the charge sheet, after which soft copies of the CDRs were deleted from the records.
It was added that the originals were still available with the mobile service providers.
Justice Thipsay informed the petitioners that he will pass order on the CDRs in due course.
