Second judge pulls out of 2G hearing

Supreme Court's Justice Anil R Dave today recused himself from the hearing on pleas of Bharti Airtel's Sunil Mittal and Essar Group's Ravi Ruia who have challenged the summons issued to them by the 2G case trial court.

Two Supreme Court judges have opted out of hearing Bharti Cellular Ltd CMD Sunil Bharti Mittal and Essar Group promoter Ravi Ruia’s appeals challenging trial court summons against them in connection with the allocation of additional spectrum in 2002.

Justice AR Dave became the second judge in four days to recuse himself from the bench hearing the case.

On April 15, Justice Vikramjit Sen, who was part of the three-judge bench including CJI Altamas Kabir and Justice AR Dave, recused himself when the petitions were taken up.

No reasons were given by the two for opting out.

Left alone, the CJI said an administrative order would be passed for listing the matter before an appropriate bench. He also ordered that trial court proceedings against Mittal and Ruia be postponed till April 22.

During the last hearing, the CBI had said that the matter should be referred to another bench headed by justice GS Singhvi, which has been monitoring the 2G probe.
