District consumer disputes redresssal forum, Chandigarh, has directed Hind Motors to pay `25,000 as compensation for delaying delivery of a vehicle and overcharging a Mansa resident.
Holding it guilty of deficiency in services, the consumer forum also directed Hind Motors (India) Limited, Industrial Area, Phase-1, to refund `21,233 charged in excess from Mansa resident Balwinder Kumar, along with `7,000 as cost of litigation.
Kumar in February 2012 had booked a Nissan Sunny car with the dealer and the vehicle was to be delivered to him in March 2012. He alleged that at the time of car's delivery, he was charged in excess and the amount was not refunded despite his requests. Therefore, Kumar moved the consumer forum seeking refund of Rs 21,233 charged in excess.
Hind Motors (India) Limited denied any overcharging and said the prices of the vehicles were increased on March 16, 2012 and only the applicable price was charged from the complainant at the time of delivery.
Unimpressed with the arguments, the consumer forum presided over by Rajan Dewan, on September 24 said, “Any revision in rates must have been done under some written order/communication. But no such order/communication has been placed on record. In such circumstances, the authenticity of the document cannot be believed and it is held that charging of the revised price, on the said basis, was clearly illegal and amounts to grave deficiency in service on its part.”
