The division bench comprising justices M Jeyapaul and Anita Chaudhary of the Punjab and Haryana high court on Wednesday recused from hearing the alleged abduction and murder case of former Punjab cabinet minister Bibi Jagir Kaur's daughter Harpreet Kaur. The case would now come up for hearing before another division bench of the high court.
The special CBI court, Patiala, had on March 30, 2012, convicted Bibi Jagir Kaur, Nishan Singh, Dalwinder Kaur Dhesi and Paramjit Singh Raipur and sentenced them to five years' imprisonment. However, the CBI judge had acquitted the four of murder charges.
All four convicts are presently out on bail, granted by the high court. But their appeals against the CBI court's orders are pending before the high court with the petition filed by the CBI for enhancement of Jagir Kaur's sentence alleging honour killing in the case.
The case had been registered on the statement of Kamaljit Singh of Begowal village (Kapurthala district), who claimed that he had married Harpreet secretly and she was pregnant with his child. As per his allegations, Jagir Kaur was against their relationship, which led to Harpreet's abduction and death in 2000. Jagir Kaur had claimed that Harpreet died due to food poisoning. She had been cremated without a post-mortem examination.
