Cancellation of Rs 400 order without the prior intimation to the customer cost dear to the online store Flipkart, as the district consumer disputes redressal forum, Chandigarh, directed the store to pay Rs 5,500 as compensation for deficient services.
The amount to be paid to the complainant, Atul Malhotra, resident of Sector 41, Chandigarh, comprises compensation amount of Rs 3,000, and Rs 2,500 as litigation expenses.
Atul had ordered a mobile phone worth Rs 400 on September 13, 2014, when Flipkart was offering 94% discount on its products. The company had promised to deliver the product by September 22, 2014. However, on September 15, the online store cancelled the order and refunded the amount after which, Atul filed the complaint.
Flipkart, in its reply, stated, "Due to the huge demand of products, and to provide customers an equal opportunity to avail the said deal, the order was cancelled."
Flipkart added there was no privity between the company and the consumer, and that he could file complaint only against the mobile manufacturer.
The consumer forum held that as interactions had happened between the complainant and Flipkart, it could not escape liability, adding the online store was liable for deficient services for not providing the promised item.
