Locking horns with the management of Chandigarh Industrial and Tourism Development Corporation (CITCO), the class 4 employees of the corporation have moved labour court against it for not implementing the increased retirement age as set under Punjab Services Rules.
There are more than 700 class 4 employees working in different units of CITCO. Under section 3.26 (b) of Punjab Service Rules, which were adopted by CITCO in1991, the retirement age of a class 4 government employee is 60 years. He can be retained only after sanction of competent authority.
In the petition, it was submitted by the class 4 employees that CITCO was meting out "step motherly treatment" to them as they were made to retire at the age of 58 years.
A CITCO order, dated November 21, 1992, had said: "Consequent upon the adoption of Punjab payscales, all rules and orders relating to the conditions of services, which include probation, seniority, pay of members of service, leave pension and other matters and also the matters relating to discipline, penalties and appeals, as for the time being, applicable to Punjab government employees, have been made applicable to the employees of Chandigarh with effect from April 1, 1991."
The order further reads that since the corporation has been following the payscales and the conditions of services in respect of its employees on pattern being followed in Chandigarh, it has now been decided that the conditions of services as are applicable to the UT administration on Punjab pattern may also be made applicable to the employees of the corporation with effect from April 1, 1991.
In the petition filed, the petitioners have also contended that the UT administration and municipal corporation and other autonomous bodies and boards have also adopted Punjab Service Rules and accordingly the retirement age of class 4 employees increased to 60 years.
The petitioners urged the court to issue a notice against this "discrimination and injustice done by the management of CITCO". They also pleaded for enhancement of retirement age to 60 years as per the rules.
The decision to move court was taken in a recently held meeting of the employees and the case has been listed for hearing on March 11.
