For failing to refund the fee to the student who left school, district consumer disputes redressal forum, Chandigarh has directed KB DAV School, Sector 7, to pay Rs 2,000 as compensation to the student, for deficient services.
Disposing of the complaint filed by Kriti Nandwani through her grandfather BS Nandwani, resident of Sector 17, Panchkula, the consumer forum also directed the school to refund the proportionate fee for the months of August and September, 2013, with paying Rs 3,000 as cost of litigation.
President of the forum, Rajan Dewan, said: "It is proved that the complainant did attend classes for a few days in July 2013 and the school at best, could have retained the fee for July…we are of the view that the complainant is entitled to the refund of fee for the months of August and September 2013 only and failure to refund the same certainly amounts to deficiency in service and unfair trade practice."
Nandwani claimed that she took admission in Class 11 with KB DAV School, Sector 7, Chandigarh, after paying Rs 19,000 as the annual dues and the fee for the quarter April 2013 to June 2013.
She claimed to have deposited Rs 7,950 as fee for the second quarter i.e. July 2013 to September 2013. Subsequently, she got admission in another school; received her school leaving certificate and also deposited the fee in that school on July 6, 2013.
She claimed that her grandfather visited the KB DAV School, and gave written requests for refund of the fee but to no avail. Only the security amount was refunded.
The school denied any deficiency and claimed that the complainant left the school of her own. It said that under the rules, it was liable to refund only the security of Rs 3,000, which had been refunded. It was also submitted that the seat left by the in July 2013 remained unfilled.
