The district consumer disputes redressal forum, Chandigarh, has directed a developer and promoter to pay Rs 50,000 as compensation to Delhi-based residents for delay in handing over possession of a designer studio.
Delhi residents Rakesh Kumar Jain and Meena Batra, had moved the consumer forum against Chandigarh Overseas Private Limited (COPL), Sector 34, Chandigarh, a company promoted by a group of developers and Greenfield Sites Management Private Limited.
The consumer forum has directed the developer and promoter to pay `9% interest on the deposited amount of Rs 4.75 lakh to the complainants since 2006 till realisation.
The complainants will also get an amount of Rs 6,250 per month from April, 2010, onwards for the delay in starting the construction till the actual date of payment along with 9% interest till payment.
The developer would also pay a minimum lease rent of Rs 30,000 from February, 2010, till date of possession along with 9% interest till payment to the complainants along with paying Rs 5,000 as cost of litigation.
New Delhi-based Rakesh Kumar Jain and Meena Batra, in their complaint before the consumer forum said Chandigarh Overseas Private Limited had allotted a design studio in the industrial complex in Industrial Knowledge Fashion Technology Park (FTP) in Sector 90, SAS Nagar.
Chandigarh Overseas Private Limited was proceeded exparte while Greenfield Sites Management Private Limited, that the complaint is not maintainable against them because it has no role in the construction work of industrial unit of FTP, and it is also not responsible for delivering the possession of the unit to the complainants.
