After nearly seven years of running from pillar to post, an ex-serviceman employed with a private detective agency in city finally received his provident fund, but only after the intervention of the district consumer disputes redressal forum, Chandigarh.
Pulling up Trig Detective Private Ltd for the delay in release of Arun Gautam’s provident fund, the consumer forum directed them to pay 25,000 as compensation for gross deficiency in service and unfair trade practice and directed them to pay an additional 7,000 as costs of litigation.
Gautam is an ex-serviceman hailing from a village in Bilaspur, Himachal Pradesh. The forum, presided over by Rajan Dewan, held: “The act and conduct of detective agency in mentioning the wrong PF account number and thereafter not facilitating the reimbursement of the complainant’s claim for more than six years certainly amounts to deficiency in service and unfair trade practice.”
Gautam had moved the forum after the detective agency at which he was employed as a security guard failed to release his PF. He claimed that he was deployed at Infosys IT Park in April 2007 and served till last week of October 2007, after which he had to leave due to serious illness.
In his complaint, he stated that the agency had failed to release his provident fund amount despite repeated requests and personal visits.
The agency, however, had told the forum that the authority concerned with maintaining Gautam’s provident fund was at Mumbai and they would forward the case to them within one day.
It was only on direction of the consumer forum in February 2014 that the detective agency got the relevant forms/papers signed by Gautam for the settlement of his PF claim.
Gautam who had been awaiting release of provident funds for more than six years, received amount of 10,749 towards his provident fund claim in March 2014.
